Penguin, your avatar has become the red X of doom. The link to it happens to be incorrect, or the hosting page is down.
Just saw this got fixed
Anyway, this DarthTrogSea + *AUS* Battleground discussion doesn't belong here. No offense, but I think it will repel those who visit the threat do get information about Caprica City

The new Battle Star Galalctica is, as far as I am concerned, the best show in existance.
As such, this map is the thing I've been waiting for. Isn't there a copy-right issue to cnsider, though? Everything you make with the MOD tools is officialy property of Lucas Arts, as per MOD tools' agreement. So vby doing this wouldn't you set up yourself to get double-sued? (Once from Lucas Arts for iviolating terms of use, and another from the Battlestar company for unauthorized use and disctribution of copyrighted content.) ...If this comment leads to this map being canceled i will never forgive myself.
Anywaysm, it looks like the best thing to happen to Battefront 2 sensethe BF1 conversion pack. And, seeing as how it's a city map, would you like me to search it for glitches/wall-hacks so that you can put some nice kill-zones in them before the final release?

I guess a sue would be possible and likely happen the way you described, but I strongly doubt that "the Battlestar company" or LucasArts would take the labour of sueing an innocent Aussie. They'd just send an E-Mail (or even a letter) telling Penguin to stop her work, if they ever noticed what's going on here.(-MOD-)_Stalin wrote: Isn't there a copy-right issue to cnsider, though? There's no money to be made from this map, so noone can sue. Lucasarts can't sue as they have released the mod-tools for us to do as we please, and Universal Studios (NBC) won't sue anyone for creating fan based fiction / stories / art etc. It has never happened.
If Penguin was infringing on copyrights by passing BSG off as her own idea, and making money by selling the map, she would get a cease and desist order first, and if she chose to ignore that, THEN she could be sued. But it won't happen though.
Anyways, enough off-toppicking. This map looks great, and I can't wait to see what becomes of it.
Penguin - what season are you on for BSG in Australia right now? We're 10 episodes into season 3 right now, and it never ceases to amaze me how much better the show gets. My only complaint is how they tend to "jump forward" in time near the end of season 2, with no real explanation about what happened in the back story, but oh well...
Keep up the good work! Maybe as a Christmas gift you'll release a beta???

Alright, so Universal Studios (I said Battlestar company sense I didn't know who made it) won't sue. As for Lucas Arts: Have you actualy read the MOD Tools terms of use? There's no money to be made from this map, so noone can sue. Lucasarts can't sue as they have released the mod-tools for us to do as we please, and Universal Studios (NBC) won't sue anyone for creating fan based fiction / stories / art etc. It has never happened.
In the Rules Governing New Levels section (emphasis added):
(7) By distributing or permitting the distribution of any New Levels, all creators or owners of any trademark, copyright, or other right, title or interest therein: (a) grant to LucasArts an irrevocable, perpetual, royalty-free, sublicensable right to distribute or exploit the New Level by any means or media (whether now known or hereafter invented), and to create and distribute by any means or media (whether now known or hereafter invented) derivative works thereof, and to charge for the distribution of such New Level or such derivative work, with no obligation to account to any creators or owners of the New Level in any manner, and (b) waive and covenant not to assert in any forum any and all moral rights (including, without limitation, rights of paternity, attribution, integrity, and participation), and authorize LucasArts to publish and exploit the New Levels (including any portions and derivatives thereof) in its sole discretion without attributing any of the foregoing to me or identifying me in connection therewith.
End quote. To sum that up, anything that exists in a new level you make, they can claim as their own. They will disregard the ownership of Battlestar Galactica content, and can then sell ANYTHING they derive from the material in that map. in other words, they could just make a total rip-off of BSG: Universal Studios challenges them, they fall back to the user agreement, and any violations there of by the map maker. Of course, chances are that they won't use it, or sue, merely because they would not want a legal conflict with something as large as Universal studios. However, I do feel that should be mentioned, merely because it makes a very good point about an unlikely yet possible event.
That said: Sense the chances of said lawsuit are VERY unlikely, I hope you continue your work with this map (And possibly other BSG ones).

That may well be, but then it would be Lucasarts, not Penguin who would be in violation of the copyright.
If you look at the long history of modders and modding, you'll see that Star Wars has been used as the basis for many a mod in many different NON-LucasArts Game Engines. The original Doom had a mod for Star Wars. LucasArts' answer was to release the original Dark Forces. Battlefield 2142 is seeing the development of First Strike. Lucasarts isn't going after any of these people. Fan Fiction RARELY (I don't remember EVER seeing a suit) evokes a lawsuit. Nor does parody (sometime though parody borders on slander - and lawsuits sometimes arise from this)
Regardless, it wouldn't happen, so I'm sorry to hijack the thread yet again.
I too would like to see a - this map released, and b - a space map (if possible) including vipers, raiders, the BSG itself, and a couple of BaseStars. That would be amazing!! Maybe there's someone out there who is adept enough at modelling to try taking this on??
The way I read that would mean that even though Penguin would create the map, LA COULD claim it as their work and decide to charge for it - thus a huge battle would ensue between LA and NBC/Universal.(a) grant to LucasArts an irrevocable, perpetual, royalty-free, sublicensable right to distribute or exploit the New Level by any means or media (whether now known or hereafter invented), and to create and distribute by any means or media (whether now known or hereafter invented) derivative works thereof, and to charge for the distribution of such New Level or such derivative work, with no obligation to account to any creators or owners of the New Level in any manner, and (b) waive and covenant not to assert in any forum any and all moral rights (including, without limitation, rights of paternity, attribution, integrity, and participation), and authorize LucasArts to publish and exploit the New Levels (including any portions and derivatives thereof) in its sole discretion without attributing any of the foregoing to me or identifying me in connection therewith.

You should try and download the seasons. I believe they're available from Itunes, or failing that, they're all available out in the ether from various torrent sites..BSG cut off near the end of season II >.<
Season 3 has been amazing so far.. the first 2-3 episodes were kind of slow, but after that its freakin' amazing!! Episode 11 of season 3 should be aired tomorrow unless they take a break until the new year..
Would it be possible for you to post pics of these two ships either here or in one of the other threads (with links of course)??I have a BSG((needs texturing)) and a viper modeled. But i don't think I'll use them for a long time.

Mhh, imagine someone uploaded this map to some place like FileFront, Battlefront Files, Megaupload, Rapidshare etc. All these places feature Advertisments, and they won't advertise for free. And with the map encouraging/obliging people to visit this sites (to download it there), this map becomes a finiancial factor.Razorpig wrote:There's no money to be made from this map, so noone can sue.
