Sketchup's Policy About Ripped Models

Post by FragMe! »

Received a response from SketchUp about my ATAP model being on the abdyla guy's site.

They did send a link to a Copyright Infringement form to fill out but in there basically said unless you can provide a valid copyright they may just come back after you. (from the above mentioned form)
IMPORTANT: Misrepresentations made in your notice regarding whether material or activity is infringing may expose you to liability for damages (including costs and attorneys' fees). Courts have found that you must consider copyright defenses, limitations or exceptions before sending a notice. In one case involving online content, a company paid more than $100,000 in costs and attorneys fees after targeting content protected by the U.S. fair use doctrine. Accordingly, if you are not sure whether material available online infringes your copyright, we suggest that you first contact an attorney
So basically they are saying unless you can prove and maybe pay for it, bugger off.
Now since I am pretty sure no one on this site has gone though the formality of actually copyrighting their assets apparently we cannot do anything about this short of just setting an written (for now) policy that we at Gametoast will not use any assets from this persons site.

That is my personal policy is anyway.

Yeah, I took a look at this too a few days ago. Both Google and Youtube don't have robust reporting systems; they make it difficult to submit copyright violation warnings if you are not the original copyright holder. The hurdles are probably precisely so that they do not have to deal with tons of fake or mismanaged reports, but it makes it difficult to see this kind of violation removed.

At the end of the day, we can really just make our policy to ignore users like this and move on. There will always be people who don't respect copyright or IP like this.

Sadly, seems like the only thing we can do is somehow limiting the downloads for people of this site, but that certainly won't hold people like abdyla off. :x

Well in all honesty, I wouldn't refer to it as talent, rather I would refer to it as devotion. And Abdyla is just taking what others have done (Of course, he/she/it usually does list what game a model is from, but sometimes not even that is listed) and taking credit for it. Okay, enough talk on this. Everyone is going to say the same thing, so I hope we can just drop it for now.

(And yes, I have had my ideas and work stolen from me before. So I do know how it feels. But it's more annoying than angering.)

Heh. This is why I'm happy all of my stuff out in the wild currently is medicore or crap beginner level stuff. If I ever get to the point of releasing (me so lazy) a finished model for any game it'll either be one that is meant specifically for a release (Gamebryo, Source) that can't be in a secure compiled level/map/mod. Or it will be in a secure compile like zeroengine .lvl.

Not counting standalone work though for UDK and the like.

Art theft happens quite allot in both 2D and 3D circles and much of the modding scenes for many games. It's easier to police on more personal level sites, but with sketchup having such high traffic and the fact it is not a model sale site, their stance is pure logic to prevent report spam.

I dare him to try it on sites like Eat3D, Polycount, Gameartisans or Turbosquid though.

Agreed, my intent was not to start bashing certain individuals but rather to point out that SketchUp does not police nor really care where things come from if it can't be proven legally.

I will say if you do use assests that are found on the sketchup site it may be possible that they are not original models but ripped from another creator. So it is more of a downloader beware kind of thing and don't be surpirsed if someone goes "oh such and such made that model".
