I'm not sure about AU1, but I'm guessing it will be released with the second DLC. (which will be released when the first DLC is made free in Spring)

I believe I read that AU1 was just like the "There is a patch for this game. If you do not download, you will be signed out of Xbox Live Blablabla..." free updates that are so common on everything (Orange Box, Tetris, Small Arms...)

Has the new patch been released? cuz I was playing online and I saw a XBL Guest and he was a blue and brown elite with assault armor

Thats not a glitch, XBL Guests are allowed to customize their armor, except that they only have access to the default armor perms and once they sign off XBL their armor settings reset.
